Terms of Use
Agreement to these terms
By downloading, accessing, or using AppNap, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the service. AppNap is operated by Gruger LLC. In these terms, “AppNap,” “we,” and “us” refer to Gruger LLC. You must be legally able to enter this agreement; if you use AppNap for another person or organization, you represent that you have authority to accept these terms for them.
AppNap
AppNap is an iPhone application that helps you make access to selected apps more deliberate through Minute Rules, Balances, Recharge, and fixed Access Windows. AppNap’s operation depends on Apple’s Screen Time frameworks, iOS, device settings, permissions, and system limits. Features may not operate when required permissions are unavailable or revoked.
Your responsibility
You are responsible for choosing your Minute Rules, maintaining access to your device and Apple account, and deciding whether AppNap is appropriate for your circumstances. AppNap is a behavior tool, not a safety, medical, parental-control, employment-monitoring, or emergency service. Do not rely on AppNap to prevent access where failure could cause harm.
Your account
An account is not required for AppNap’s on-device Minute Rules. If you create an optional AppNap account, it uses Sign in with Apple. You are responsible for your device and Apple Account security and for activity under your AppNap account. Keep your account information accurate and contact us if you believe the account has been compromised. You may delete the account at any time from AppNap Settings.
Acceptable use
You may not interfere with the service, attempt unauthorized access, bypass security or technical limits, misuse another person’s account or device, reverse engineer the service except where law permits it, introduce malicious code, or use AppNap unlawfully. We may limit or suspend access when reasonably necessary to protect users, AppNap, or others.
Purchases
If AppNap offers an in-app purchase or auto-renewable subscription, the product title, duration, price, and included value will be shown before you confirm. Apple bills purchases to your Apple Account. Subscriptions renew unless canceled in your Apple Account settings at least 24 hours before the end of the current period. You can manage or cancel through Apple’s subscription settings. Refunds and billing disputes are handled under Apple’s policies.
Ownership and feedback
AppNap and its software, design, text, graphics, and other content are owned by Gruger LLC or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use AppNap on Apple-branded products you own or control, subject to these terms and Apple’s usage rules. If you send feedback, you permit us to use it without restriction or compensation.
Third-party services and Apple
AppNap uses services provided by Apple and may use other service providers. Their terms and privacy practices may apply to their services. Apple is not responsible for maintaining or supporting AppNap. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce the terms relating to your license to use the app. Apple’s Standard Licensed Application End User License Agreement also applies except where these terms provide additional terms that do not conflict with it.
Availability and changes
AppNap may evolve as Apple changes its platforms and policies. Features may be modified or discontinued, and uninterrupted or error-free operation cannot be guaranteed.
Disclaimers
To the fullest extent permitted by law, AppNap is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that the service will always block or allow an app at a particular time. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Gruger LLC, its affiliates, and its service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of data, or loss of profits arising from your use of or inability to use AppNap. Our total liability for claims relating to the service will not exceed the amount you paid AppNap during the 12 months before the claim or US$50, whichever is greater. These limits do not apply where prohibited by law.
Termination
You may stop using AppNap and delete your account at any time. We may suspend or terminate access for a material breach of these terms, unlawful conduct, security risk, or discontinuation of the service. Terms that by their nature should survive termination will continue to apply.
Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. You and Gruger LLC consent to the jurisdiction of the state and federal courts located in Texas for disputes arising from these terms or AppNap. Nothing in these terms limits any mandatory consumer protections that apply to you.
Changes to these terms
We may update these terms as the service or law changes. We will post revised terms here with a new effective date and provide additional notice when appropriate. Continued use after updated terms take effect means you accept them.
